These Terms and Conditions govern the use of this Website, which is defined below. By using this Website, you will be taken to agree to them. If you do not agree to these Terms and Conditions in their entirety, then you should exit this Website.

You should also refer to Cinqs' Web Privacy Policy.

 

1) TERM OF AGREEMENT

This agreement is a contract between us, Cinq, and you, the party concerned.

This agreement becomes effective when you access this website, Cinqrestaurants.co.uk, as a Visitor, or as a Member, and utillise, in any shape or form, any of its services from the website and from the corporate entity as a whole.


2) DEFINITIONS

"Visitor" means a person who is the subject of, and has accessed the Cinq website domain Cinqrestaurants.co.uk either for, browsing purposes, or with intent to open an account whilst still being present at the preliminary stages of account activation, and hereby not possessing the means necessary to carry out transactions and book deliveries.

"Member" means a person, organisation, or entity who is the subject of and has been granted an account, and is capable of using, and is authorised to use the account in question as is necessary, and has logged into the account with the proper credentials, and has the means necessary hereof to carry out transactions and book deliveries as solicited by the account holder. Subject to cinq conditions.


3) CONTENT

All available graphics, texts, and software modules are rendered to enable comfort, clarity, and assistance in placing orders on this website.

We provide you with the option to order food and drink as is available from the website's daily menu, and subject to availability.

For your own convenience, you can print a summary of your order prior to hitting the "Confirm" button. Please note that, due to the fact that at this stage you may still modify or cancel your order altogether, this printout:

· is not necessarily a true and accurate record of an order, whether existing or cancelled;
· cannot be used as evidence against a faulty delivery;
· cannot be used as evidence against a billing error;
· is not a valid receipt.

Only an invoice, whether tangible in paper form, or intangible on the website, can count as proof of an existing and accurate order, and may be used as evidence against an error on our part, be it a delivery and/or a billing error.

Visitors Cart
Every visitor to our online shop will be given a 'Visitors Cart'. This allows the visitor to store their products in a temporary shopping cart. Once the visitor leaves the online shop, so will the contents of their shopping cart.

Members Cart
Every member to our online shop that logs in is given a 'Members Cart'. This allows the member to add products to their shopping cart, and come back at a later date to finalise their checkout. All products remain in their shopping cart until the member has checked them out, or removed the products themselves.


4) ACCEPTANCE OF ORDERS

All orders submitted through our website are confirmed by e-mail, by fax, or by telephone after submission. No order should be deemed to be accepted without this confirmation. All orders are fulfilled subject to these terms and conditions.

A minimum transaction amount of £25.00 is required to complete an order.

Should the total order amount result in being out of threshold, you will not be granted further access in the formation of the order, and hence, book a delivery.

Orders placed before 10:00 AM should be delivered by your required time, or any other day upon request by the client. Orders placed after 10:00 AM on the day you require your order, we will try our best to forfill your order reaching you.

It might not be possible for us to accept orders from certain locations. It is your responsibility to verify that your location qualifies for delivery.

Should you be billed for an order that you placed whereby we do not deliver to your location, you may be re-credited for the amount you paid, minus all additional surcharges made payable in merchant fees and administration costs arising from that transaction.

5) LIABILITY & ACCOUNTABILITY

The client's responsibilities consist of:
· ensuring the validity of your location;
· providing true and accurate billing details;
· paying the bill in full when it is due.

The merchant's responsibilities consist of:
· providing food and drink that is fit for human consumption;
· debiting the agreed sum of money from the client;
· delivering the order as requested by the client.


6) ACCOUNT REGISTRATION

We will set up your account immediately after you finish completing the required information in the mandatory fields and submit this information to us.

It is your responsibility to provide us with accurate and non-fraudulent information during the creation of your account.

It is not required, nor is it requested of you to submit any of your banking or credit card details during account setup.

Below follows a summary of the mandatory fields:
· First Name
· Last Name
· E-Mail Address
· Street Address
· Post Code
· City
· Country
· Telephone Number
· Password
· Password Confirmation
· Account Agreement number or code.

Once your account is set up, you will be able to place orders online, as well as manage your account, view the orders you have previously made, add up to five different addresses in the address book provided, subscribe or unsubscribe from newsletters, receive or halt product notifications, tell a friend about a particular product, submit reviews about products you have ordered, and more.

7) ACCOUNT TERMINATION

We reserve the right to terminate your account at any time should we have sufficient grounds to conclude that these terms and conditions have been violated. This includes non payment of account or misuse of the said account.

Should you wish to terminate your account with Cinq, you may do so by notifying us by e-mail and by specifying in your message:
· the purpose of your message i.e. "account termination" which can be written under the "Subject" field as provided;
· mandatory identification about yourselfor your company, such as your first name, your last name, and your e-mail address (your password is not required).


8) CANCELLATION AND REFUNDS

As soon as a transaction is made, a billing contract is established between the client and the merchant and any payment that is due is billed.

A transaction is effectively made when:
· correct credit card details are entered;
· the client submits the order by clicking the "Confirm Order" button.

Should you wish to cancel an order, you can do so prior to entering into a billing contract only.
When an order is placed and paid for, but needs to be cancelled, by the client, it is only up to the discretion of Cinq whether a refund will be given. Cinqs decision is final.
In the event of a picking error on our part, you shall be entitled to a full refund on any unsolicited goods left unclaimed and billed for.

With the exception of cases where mistakes can be proven otherwise, refunds are only applicable whilst:
· the products are due to exchange hands and be passed on from the merchant to the client;
· in the presence of a Cinq courier acting as a witness.


9) BILLING

We take credit card and debit card payment.

The following credit cards are compliant:

· Mastercard
· Visa
· Delta, Switch or Solo

In the event that the client submits non-compliant credit card details, we may, at our discretion, charge the client for any surcharges deemed excessive and made payable to us by the creditor as merchant fees.


10) COOKIES

"Cookies" are a standard method for storing small pieces of data on a web client (i.e. the web browser on your computer).

Any Web server (including this one) may:
· store one or more cookies in your browser;
· request your browser to transmit the data to the Web server.

This Website may store cookies on your web client in order to better serve you upon your subsequent visits to this Website.

12) GOVERNING LAW

To the maximum extent permitted by law, this agreement is governed by the laws of England and Wales and you hereby consent to the exclusive jurisdiction and venue of courts in England and Wales in all disputes arising out of or relating to the use of these terms and conditions.


13) COPYRIGHT NOTICES

All copyright in this Website, with the inclusion of the Cinqs logo, is the property of Cinq.

Reproduction in any shape or form of the Cinqs, commercial usage, or capital gain acquired from the logo as well as from the website domain name Cinqrestaurants.co.uk is strictly prohibited.

Other than for the purposes of and subject to the conditions prescribed under these terms & conditions, you may not, in any shape or form or by any means:
· distribute, modify, copy, adapt, store, transmit, display, publish or otherwise reproduce in any way any of the material in this website;
· commercialise any information, products or services obtained from any part of this website;
· do any of the above without the express written permission of Cinq.


14) LIMITATIONS ON USE

Despite the safety precautions undertaken by us, you are hereby notified of the possibility of hackers infiltrating our website.

We do not tolerate spam attacks and reserve the right to pursue anyone in justice caught with, or otherwise suspected of perpetrating any wrongdoing deemed illegal which does not fall in line with relevant applicable laws.


15) DISCLAIMER

To the extent permitted by law, we will not be held responsible for any damages, however unlikely, that you or your business may suffer as a result of the aforementioned stipulated in term (14).

We disclaim any warranty or merchantibility or fitness for a particular purpose, with the exception of our legal obligations.

We make no warranties of any kind, expressed or implied for the services we provide.

16) INDEMNIFICATION

Despite the safety procedures undertaken, the customer agrees that we offer no clear cut guarantees as to the security of this website being infallible from coming under attack by forces outside of our control such as viruses, hackers, spammers, and the like.

The customer agrees that by accessing this website via internet connection, you are accepting the fact that Cinq shall on no account be held liable for any outside manipulation whereby we have no control over and/or for any technical problem(s), if any, arising from and caused by unsolicited third party sources during your browsing of our website.


17) CHANGES TO THE TERMS OF SERVICE

We may in all likelihood amend our Terms & Conditions should the occasion arise do so.

We reserve the right to revise its policies at any time without notice.


18) ENTIRE AGREEMENT

This Agreement constitutes the entire understanding and agreement between Cinq and you with respect to the transactions contemplated, and supersedes any and all prior or contemporaneous oral or written representation, understanding, agreement or communication relating thereto.
